Congresswoman Carol Miller from West Virginia strongly criticized the Biden Administration's final rule on electric vehicle tax credit guidelines, accusing them of benefiting the Chinese Communist Party at the expense of American manufacturers. She stated, "Once again, the Biden Administration is allowing the Chinese Communist Party to profit from American tax credits. These weak guidelines benefit the CCP while American manufacturers are pushed aside."

In response to the perceived shortcomings of the administration's guidelines, Congresswoman Miller took action by introducing the End Chinese Dominance of Electric Vehicles in America Act of 2024. The proposed legislation aims to tighten the Foreign Entity of Concern definition for the 30D electric vehicle tax credit and prevent Chinese companies from accessing U.S. tax dollars.

The bill specifically targets loopholes that could allow Chinese entities to exploit the American tax credit system. It includes provisions such as closing the 'Billionaire Loophole' and the 'Chinese Manufacturing Loophole', which would prevent wealthy Chinese business owners from directly receiving American tax dollars and restrict China from leveraging its battery supply chain dominance for the 30D credit.

Congresswoman Miller's initiative is part of her broader efforts to safeguard American advanced manufacturing and ensure that countries like China do not benefit from American tax credits. She emphasized the importance of passing the bill promptly to counter what she described as the Biden Administration's "disastrous rulemaking" that could potentially divert tax credits to adversarial nations.

The congresswoman's stance reflects a growing concern among lawmakers about protecting American interests and maintaining the integrity of the tax credit system in the evolving electric vehicle industry landscape.
